It is the good book that says a soft tongue can break a bone and that is what it did last Monday in Mombasa.

But this time, it broke the shackles off 19-year-old Mary Auma, a student accused of selling unlicensed local brew.

The teen said she was arrested by police in a swoop that saw the real culprits flee leaving her behind.

“Your honour the truth is that I don’t sell alcohol. The ten litres found in our house was planted on me by police when the real owner, my mother, fled. I have now spent an entire weekend on the police cell’s cold floor and I have missed school because of the arrest,” Auma narrated to Mombasa Resident Magistrate Emmanuel Mutunga.

She went on: “I had just arrived from school and was resting when the police came into our hose and started searching. My mother and others fled in the melee leaving me behind. I tried explaining to them (police) that I was not the owner of the alcoholic drink but they asked me to come and explain that in court. So I am here before you, your honour.”

The magistrate looked at the girl who appeared frightened in the dock and released her. “I have all the reasons to believe all you are saying is true. You are hereby set free,” the court ruled.

Meanwhile in Nairobi, a man’s attempt to justify assaulting his wife did not go down well in court.

55-year-old Samuel Ndege told a Makadara magistrate court that he clobbered his wife because “she had a habit of drinking and returning home late” but the court did not find merit in the explanation.

Ndege, who is charged with assaulting his wife Margaret Kemunto on May 22 last year at Mukuru Kwa Njenga slums in Nairobi, was placed under custody until his case is mentioned next Monday.

The prosecution told the court that Ndege had beat up the wife because she collected rent from their rental units without his knowledge.

“The accused picked a machete and chased the complainant who outran him and went to report to the police,” reads part of the charge particulars.
